Your privacy is important to us. This Privacy Policy (“Policy”) is the terms (“Terms”) that govern the use of the website (the “Site”) and the Kidizen mobile application (whether on iOS, Android or another platform, the “App”), both of which are owned and operated by Kidizen, Inc., a Delaware corporation (together with its successors, assigns, and licensors, “Kidizen,” “we,” “us,” or “our”).

The Policy defines the privacy options of each of our users (each, a “user,” “you,” or “your”) and describes how  we collect on the Site, the App, in email, text, and other electronic messages between you and the Services, when you interact with our advertising and applications on third-party websites and services, if those applications or advertising include links to this Policy, and any of our related sites, services, tools or applications (together with the Site and the App, collectively, the “Services”).

Kidizen operates certain websites and mobile applications under contract with third parties, such as participants in Kidizen’s Rewear Program and related initiatives. This Policy shall also govern all use of such websites and applications, and the term “Kidizen” includes all third parties participating under contract with Kidizen, and the term “Services” includes all websites and mobile applications owned and operated by Kidizen and such third parties pursuant to such contracts. Use of Kidizen Apps may be subject to the acceptance of additional terms of use upon installation (the “Additional Agreements”).

This Policy does not apply to information collected by: (1) Kidizen outside of the Services; or (2) any third party including through any application or content (including advertising) that may link to or be accessible from or the Services.

PLEASE READ THIS POLICY CAREFULLY BEFORE USING THE SERVICES. By using the Services in any manner, whether you create an account with us as described below or use the Services as a guest, you agree to the Terms, including any additional terms and conditions and policies referenced herein or available by hyperlink. If you do not agree to the Terms, you are not allowed to use the Services. We reserve the right, at our discretion, to change, modify, add or remove portions of the Terms or any such additional terms and conditions or policies at any time, and we will post the Terms. Please check these Terms and any such additional terms and conditions or policies referenced herein periodically for changes. Your continued use of the Services following the posting of changes to the Terms or any such additional terms and conditions or policies referenced herein will mean you accept those changes.

The Services is offered and available to users who are 13 years of age or older, or of legal age to contract, whichever is older. Users must also reside in the United States or any of its territories or possessions. By using the Services, you represent and warrant that you are of legal age to form a binding contract with Kidizen and meet all eligibility requirements. If you do not meet all of these requirements, you must not access or use the Services. If you are under 13, you may not submit or post any information or material on the Services or otherwise provide such information to Kidizen, including but not limited to personally identifiable information. Users of the Services have the option of submitting information about their children. Kidizen will not intentionally collect any personal information from children under age 13.


We operate the Services are based on the content, listings, and the things that you post, browse, buy and sell. The Services also allow you in some situations to add your comments and opinions, to post pictures and other content, and to exchange messages with other users. This policy applies to all information collected through the Services and any information you provide to Kidizen, whether or not you create an account with us. To use certain features of the Services or participate in certain activities sponsored by Kidizen, you will be required to create an account with us. The personal information we collect when you create a Kidizen account may include: your name; your email address; telephone number; your home or business address and zip code; and a user ID and password that you select. You may also choose to access the Services through a third-party service such as Facebook, and we collect personal information provided through such third-party service in accordance with your privacy settings with such third-party service. We may also collect personal information that you voluntarily provide to us when you use any of the Services or participate in certain Kidizen-sponsored activities. Such information may include your text, photographs, video, graphics, music and other content relating to item listings, your home or business address, your credit card and other payment information in connection with item purchases, and your bank account number and other information in connection with withdrawal of funds. You may also choose to submit information about your child or children in connection with your use of the Services, including your child’s or children’s name(s), age(s), size(s), gender(s) and photos and other content relating to your child or children. We may collect personal information about you that is provided by other users, such as through comments or likes of items you post. We also collect information about transactions you conduct through the Services, such as transaction dates and purchase prices.


The Services include areas that allow you to list items (and your related materials) and to share your opinions and your comments. The Services may also include areas that allow you to post pictures and other content relating to your children, children’s fashion in general and other topics. Some information you choose to post to the Services may include personally identifiable information. We urge you to exercise caution when providing personally identifiable information. Remember that any personally identifiable information you disclose in the public areas of the Services can be viewed by other persons who access the Services.

The Services also include features allowing you to exchange messages with other users in a non-public setting. While it is not our policy to generally monitor all messaging activity between or among users, we advise you that we may review, disclose or use information included in any such messaging activity if required to do so by law, judicial or governmental mandate or, to protect the rights, property, or personal safety of Kidizen, users of the Services or the public.


In addition to the personal information you supply, we collect certain information automatically as you navigate the Services to evaluate how you and other users use and interact with the Services. We use such data in the following ways: to improve the design of the Services, to provide personalization on Services, to evaluate the performance of our various features, activities and programs and for our internal business analysis purposes. We may also display certain portions of your usage data on portions of the Services for the benefit of other users, such as by displaying when a seller has last accessed the Services. The technologies we may use to gather this non-personal information may include analytics software, IP addresses, cookies, browser detection, device detection and weblogs and other tracking technologies. We collect information about your computer, internet connection, browser type, operating system and the equipment you use to access our Site, and usage details.


Our primary goal in collecting your information is to provide you with a personalized, relevant, and positive experience when using the Services.

We use information provided by you to manage your account, including expiration and renewal notices, to process transactions and to provide the features of the Services, to present and tailor content in a manner effective for you and your device, to notify you about changes to the Services or address questions you may have about the Services, and to send you messages in accordance with your marketing preferences. We also use information that we collect about you or that you provide to us, including any personal information to provide you to carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection; to allow you to participate in interactive features on the Services; and in any other way we may describe when you provide the information or for any other purpose with your consent.

We may contact you with promotions and updates relating to the Services, or for other activities and purposes. The contact information you submit will not be used for these purposes if you choose not to receive such communications. You can control your privacy preferences regarding such communications (see the section below entitled “Your Privacy Preferences”) and can unsubscribe to any emails you receive.

From time to time, you may be invited to participate in Kidizen sponsored activities or programs. Kidizen may request that you provide some or all of the above listed personal information to participate in those activities or programs. We use information collected from activities and programs to learn about users in order to improve our services and develop new products and services of interest to our customers.

We may from time to time select certain listings posted by users within the Services and display such listings for promotional purposes on a third-party social network, such as Facebook, Twitter, Instagram or Pinterest, or via email or blog postings. We may use information you submit to the Services as well as personal information (such as usernames) in connection with any such external sharing of select listings.

As discussed above, we may use analytics software and other tools to collect data about how users use and interact with the Services. We may use this data to better understand various aspect of the Services, such as which features of the Services are most useful to users and which features may require improvements in future iterations of the Services. We may detect the type of web browser or device you are using to optimize the performance of the Services and to understand the mix of browsers and devices used by our users and visitors.

Kidizen may also contract with unaffiliated third parties to provide services, such as software for certain features within the Services, payment processing, customer communications, analyzing and evaluating the information we collect, and other services. When we do this, we may provide your personally identifiable information to third parties only to provide those services, and they are not authorized to use your personally identifiable information for any other purpose.


The safety and security of your information also depends on you. Where you have chosen a password for access to certain parts of our Services, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. We urge you to be careful about giving out information in public areas of the Services. The information you share in public areas may be viewed by any user of the Services.


Our Services are not intended for children under 13 years of age. No one under age 13 may provide any personal information to or on the Services. Kidizen will not knowingly collect any personally identifiable information submitted by visitors to the Services site who are under the age of 13. If you are under the age of 13,  do not use the Services or submit any personal information through the Services or any of the Services’s features. We encourage parents and legal guardians to monitor their children’s internet and mobile device usage and to help enforce this privacy policy by instructing their children never to provide personal information through the Services. If you have reason to believe that a child under the age of 13 has provided personal information through the Services, please contact us, and we will endeavor to delete that information from our databases.

California residents under 16 years of age may have additional rights regarding the collection and sale of their personal information. Please see Notice to California Residents for more information.


As set forth above, the Services allow (but do not require) users to submit information about their children. Such information can be saved by creating a filter and may include your child’s or children’s name(s), age(s), size(s), gender(s) and photos of your child or children or if a user includes the information in the biography, shop image or shop background image. Submitting information about your child or children is always optional. We urge you to exercise caution when submitting information about your child. If you choose to submit your child’s name or a photo of your child, we may use that information to customize your experience in using the Services (such as by displaying the child’s name and photo in your private profile or in connection with search results), but we do not display or disclose your child’s name or photos of your child to other users or members of the public if it is created in a saved filter. If you choose to submit other information about your child (i.e., age, size or gender), we may display such information on your public profile (which may be accessed by other users and visitors of the Services) or otherwise use such information to facilitate your discussions and transactions with other users. You may adjust your biography, shop image or shop background with respect to information about your child’s age, size and gender in the account settings page of the App. You may also change your biography on the Site but your shop image and background image cannot be changed on the Site.


Each time you post an item to the Services, the item listing will be visible to all Kidizen users as well as members of the public who visit the Services. If you no longer want Kidizen to display the items you have posted, you can delete such postings through the Services. If you would like to delete other content you have posted to the Services and are unable to do so using features within the Services, please contact us at

Kidizen may provide or make available to users marketing communications such as e-mail newsletters, product and service updates and promotions. Kidizen users generally find this type of information useful. Should you choose to not receive such future communications, you can follow the “unsubscribe’” instructions at the bottom of the email sent by Kidizen.


You can access and maintain your personally identifiable information on your profile page via the App and the Site.

If you delete your user content from the Services, copies of your user content may remain viewable in cached and archived pages, or might have been copied or stored by other Services users. Proper access and use of information provided on the Services, including user content, is governed by the Terms of Use for the Services.

California Data Subject Privacy Preferences

California Civil Code Section 1798.83 permits users who are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. To make such a request, please contact us using the information at the end of this Privacy Policy.

Opt-Out and Other Privacy Rights

International data protection laws may give a person whose personal information is processed or used by or through the Services (a “data subject”) certain rights. Users are required to notify data subjects when the user has obtained a data subject’s personal information and the specific purposes for which the personal information may be used. It is the obligation of the user of the Services to obtain consent from the data subject for the use of their personal information.

All users and data subjects may ask us to take the following actions if we hold any of your personal information:

Opt-out. Stop sending you direct marketing communications. You may continue to receive service-related and other non-marketing emails.
Access. Provide you with information about our processing of your personal information and give you access to your personal information.
Correct. Update or correct inaccuracies in your personal information.
Delete. Delete your personal information.
Transfer. Transfer an electronic copy of your personal information to you or a third party of your choice.
Restrict. Restrict the processing of your personal information.
Object. Object to our reliance on our legitimate interests as the basis of our processing of your personal information.

You can submit these requests by email to We may request specific information from you to help us confirm your identity and process your request. Applicable law may require or permit us to decline your request. If we decline your request, we will tell you why, subject to legal restrictions. If you would like to submit a complaint about our use of your personal information or our response to your requests regarding your personal information, you may contact us or submit a complaint to the data protection regulator in your jurisdiction.

If we hold your personal information in connection with services that we provide to one of our users, we will direct your request to the applicable user of our Services.


The Services are hosted in the United States and are intended for use by U.S. residents. If you are using or visiting the Services from outside the United States, your information will be transferred to, stored and processed in the United States in accordance with this Privacy Policy and applicable United States laws. By using the Service, you consent to transfer of your information to our facilities as described in this Privacy Policy.


We may disclose anonymous, aggregated information about our users, and any other information concerning the Services that does not identify any individual, without restriction.

We reserve the right to disclose your personally identifiable information as required by law and when we believe that disclosure is necessary to protect our rights and/or comply with a judicial proceeding, court order or legal process. We reserve the right to disclose your personally identifiable information to enforce or apply our terms of use or terms of sale and other agreements, including for billing and collection purposes. If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of Kidizen, our customers, or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.

It is also possible that Kidizen would sell all or substantially all of its assets and business. In any transaction of this kind, customer information, including your personally identifiable information, may be among the assets that are transferred. If we decide to so transfer your personally identifiable information, you will be notified by email or a post to the Site and the App.

We may disclose personal information that we collect or you provide as described in this privacy policy to: (a) contractors, service providers, and other third parties we use to support our business and who are bound by contractual obligations to keep personal information confidential and use it only for the purposes for which we disclose it to them; (b) to fulfill the purpose for which you provide it. For example, if you give us an email address to use the “email a friend” feature of our Services, we will transmit the contents of that email and your email address to the recipients; (c) for any other purpose disclosed by us when you provide the information; and (d) with your consent.

The Services contain links to other websites. Kidizen is not responsible for the privacy practices of these other sites. We encourage you to be aware when you leave our Services, and to read the privacy statements of each web site that collects personally identifiable information. Some linked sites may be co-branded with our trademarks and those of our business partners. They may have the look and feel of, but the URL in your browser window will indicate that you are visiting a different site. This policy only applies to information collected by Kidizen.
